Trade Union Movement Division

Section Objectives

  1. Ensure applications for registration of Trade Unions, Federation of Trade Unions and mergers with Federation of Trade Unions in accordance with the requirements of the law;
  2. Ensure that cases of Trade Union recognition claims involving the investigation of eligibility issues are resolved in accordance with the requirements of the law;
  3. Ensuring matters related to planning and research on the following matters are handled accurately and with quality:-
    • Determining and monitoring the department’s policy;
    • Preparation and implementation of Business Plan and Annual Work Targets, – review of the Customer Charter;
    • Review of the Trade Union Act 1959;
    • Study and statistical analysis of Trade Unions;
    • Study on the profile of unions/Trade Union officers as well as;
    • A study of the Trade Union movement.

Section Functions

  1. Process applications as follows:-
    • Registration of Trade Unions/federation of Trade Unions;
    • Notice of change of Trade Union officers/employees;
    • Change of registered office of the Trade Union.
  2. Manage and handle cases on eligibility issues;
  3. Process applications for merger with the Federation of Trade Unions;
  4. Process merger applications with external Malaysian consulting bodies
  5. Process notices of dissolution of Trade Unions and applications for cancellation of Trade Union registration certificates at the request of Trade Unions;
  6. Process the cancellation of Trade Unions that do not comply with the Trade Union Act 1959;
  7. Set and monitor the implementation of the Department’s policy;
  8. Conduct collection, research and analysis on Department statistics, profiles of Trade Unions and their officers, as well as Trade Union movements;
  9. Managing matters related to the Trade Union management course;
  10. Process applications for leave without a record for the purpose of courses organized by the Trade Union.

Legislation and Enforcement Division

Section Objectives

  1. Enforcing the Trade Union Act 1959, the Trade Union Regulations 1959 and the Trade Union Regulations;
  2. Ensuring Trade Unions comply with Trade Union legislation in order to create Trade Unions that are responsible and provide benefits to their special members and general workers;
  3. Provide advice on Trade Union legislation so that Trade Unions can function efficiently, fairly and effectively.

Section Functions

  1. Carry out inspection of the enforcement of the financial management and administration of the Trade Union;
  2. Record the Annual Financial Statement of the Trade Union;
  3. Approve the appointment of a certified External Auditor;
  4. Register the application for registration of new regulations or amendments to the regulations of the Trade Union;
  5. Registering an application to change the name of the Trade Union;
  6. Handling internal disputes of the Union referred to jointly by the parties involved in the dispute;
  7. Handle complaints related to Trade Unions;
  8. Ensuring the conduct of secret ballots on delegates, election of officers, applications for strikes and lock-outs, amendments to regulations, levies and consolidation of Trade Unions in accordance with the provisions of the law;
  9. Carry out prosecution actions.
