Trade Union Registration<\/strong><\/h4>\n\n\n\n

The main activity of this department is to consider and make decisions on trade union registration applications. A trade union needs to be registered to enable it to enjoy the rights and privileges as a legal union. Union registration can be done through  e-TUIS<\/a><\/strong> .<\/p>\n\n\n\n

Enforcement Inspections<\/strong><\/h4>\n\n\n\n

This department handles and decides internal trade union disputes which are referred with the consent of the parties involved in the dispute.<\/p>\n\n\n\n

Trade Union Investigations And Prosecutions<\/strong><\/h4>\n\n\n\n

This department conducts investigations into trade union complaints including strikes, lock-outs, secret ballots and misuse of union funds. The department also conducts prosecutions against any union found to have violated the Trade Union Act 1959, the Trade Union Regulations 1959 and the Trade Union Regulations.<\/p>\n\n\n\n

Processing and Registration of Applications, Statutory Notices<\/strong><\/h4>\n\n\n\n

This department also processes and registers statutory forms as follows:<\/p>\n\n\n\n

  • Trade Union Registration Application (Form B)<\/li>\n\n\n\n
  • Application for registration of new regulations\/or changes to regulations (Form K)<\/li>\n\n\n\n
  • Notice of change of Union name (Form G)<\/li>\n\n\n\n
  • Notice of change of registered office of the Trade Union (Form J)<\/li>\n\n\n\n
  • Notice of change of trade union officers and employees (Form L&U, Form L and Form L(1))<\/li>\n\n\n\n
  • Notice to join the Federation of Trade Unions (Form P, Form Q and Form R)<\/li>\n\n\n\n
  • Application to join a consulting body outside Malaysia (Form W)<\/li>\n\n\n\n
  • Notice of dissolution of the Trade Union and application for cancellation of the Trade Union registration certificate at the request of the Trade Union (Form I & Form E)<\/li>\n\n\n\n
  • Cancellation of a Trade Union that does not comply with the Trade Union Act 1959 (Form F)<\/li>\n\n\n\n
  • Recording Annual Financial Statements (Form N)<\/li>\n\n\n\n
  • Recording the result of a secret ballot (Form U)<\/li>\n\n\n\n
  • Issuing witness summons (Form V)<\/li>\n<\/ul>\n\n\n\n

    Technical Advisory Services<\/strong><\/h4>\n\n\n\n

    This department holds lectures, courses and dialogues for officers as well as members of trade unions and employers for the following purposes:<\/p>\n\n\n\n

    • provide guidance and advice so that they can carry out their responsibilities effectively;<\/li>\n\n\n\n
    • increase knowledge and understanding of their roles and obligations in efforts to foster and maintain the harmony of enterprise relations;<\/li>\n\n\n\n
    • improve their level of education and skills on trade union law and related labor matters<\/li>\n<\/ul>\n\n\n\n

      Functions of Trade Unions<\/strong><\/h3>\n\n\n\n
        \n
      • Create communication channels between employers and employees.<\/li>\n\n\n\n
      • Protecting the welfare and benefits of members.<\/li>\n\n\n\n
      • Representing trade union members in enterprise disputes.<\/li>\n\n\n\n
      • Organize activities that can improve the knowledge and skills of members.<\/li>\n\n\n\n
      • Keeping, updating and maintaining the member register.<\/li>\n\n\n\n
      • Hold committee meetings regularly in accordance with trade union regulations.<\/li>\n\n\n\n
      • Manage the finances and maintain the accounts of the trade union in accordance with the law.<\/li>\n\n\n\n
