Is the establishment of a trade union limited to workers only?

No, the employer can also establish a trade union specifically for them.

What are the essential conditions that enable a trade union to be established?

They must consist of those who work, work in a particular establishment (establishment, trade, job or industry) or in any similar trade, job or industry. Has been on duty for at least a year. Union officers must be 21 years of age and above.

Can employees in the public/government sector join with the private sector to form a trade union?

Can’t.

Are all public and statutory sector workers allowed to be union members?

Nope. Those who are prohibited from becoming members of the union are: Members of the Royal Malaysian Police, members of any prison service, members of the armed forces, public officers serving in a secret or security capacity, and public officers prohibited under -any written law, or public officials who hold a position in the Management and Specialist Group other than public officials, or a category class or are public officials in the group, who are not exempted by a written instruction issued by Chief Secretary.

Who is eligible to be a Trade Union officer?

Malaysian citizens and aged 21 years and above. Not an official of a trade union that was ever canceled by KPKS. Not an office holder or employee of a political party.
